We have endeavoured to ensure our users have the best experience and easy access to physicians and health professionals to improve the health and wellbeing and quality of life of themselves and their loved ones. However, similar to every aspects of our society and the world that we live in, there has to be some

By accessing our Website or apps, and by using our website and related apps and software-s you agree to be bound by these terms whether or not you have read them. If you do not agree with our terms and conditions you must not use our website, apps and integrated platforms.

This is a binding legal contractual agreement between “You” and “We or US”

Glossary of terms:

” You” refers to any user or entity who views, surfs , or uses our websites, apps and platforms for the purpose of the mere view or use , whether on behalf of a minor , senior , or another person or entity or for
themselves.

” We or Us” refers to the owners and operators of 121clinicians and its websites, apps , other software or integrated technologies that are used for facilitating healthcare services provided by physicians and health professionals.

“Telehealth”, “Telemedicine”, or “Virtual care” refers to providing “healthcare services” or “informational and educational services ” remotely by the use of technology that connects the patients or clients to the
service providers and does not necessarily require long distances.

” Providers” : Providers include any physician, specialist, healthcare professional who provides health related care or professional advice.

“Professional Healthcare Services”: Are direct involvements in the management and care of an specific patient.

” Informational or educational services” : Are general medical knowledge and information about a particular disease or medical condition or various stages of a disease or combination of diseases and how
these conditions are treated in the jurisdiction that provider is licensed to practice and does not include direct involvement in the care of any specific patient.

” Staff”, “Customer Support” , ” Administrative Assistant” , ” Medical Office Assistants or MOA” , and ” Receptionist” or similar terms that may be used by staff at 121clinicians to describe their role or position refers to ” NON-MEDICAL” people who are not trained physicians or health professionals.

Emergency Situations or Urgent Medical Conditions:

Telehealth and Telemedicine services offered at 121clinicians are NOT for EMERGENCY situations or urgent medical conditions. In Cases of emergency please call 911 in North America or any phone numbers assigned by authorities in your jurisdiction to access urgent care or ambulance and attend to the nearest emergency department or hospital.

Age Restriction:

People under the age of 16 years old MUST not create stand alone user accounts for themselves to use services offered via 121clinicians and its integrated platforms. For under 16 years of age, verifiable parental consent is required to create an account. Parents and guardians are allowed to create for their dependent children.

Truthfulness obligation:

The same as a physical medical center and hospital that you attend and provide your personal and demographic information, you must provide genuine answers to questions to create your account. This is your legal obligation according to the law.

Transferring or sending your existing medical records to 121clinicians

Registered patients and clients are able to send their medical information via our secure platform if a physician or health professional has agreed to receive your medical records. If you have booked a consultation with a physician or health professional it is in your best interest to send any relevant existing medical records, investigation results or medication list related to your health to be uploaded into your medical file. If you have any questions or technical difficulties please do not hesitate to contact us.

Access to your medical records:

Patients and clients have the right to request access to their medical records for a fee. The medical records can only be sent to another physician office, medical center or hospital and requires a written signed request to be faxed directly by that entity to 121clinicians. The forms are available in each physician office, hospital or medical center that you want to transfer your medical records to.

Language and Communication: 

The languages that each physician and health professional is fluent in communication are described in
their profile in 121clinicians website. It is your responsibility to ensure booking with a physician or health professional that you can easily communicate with or otherwise arrange for a professional translator in advance. Physicians and health professionals are not liable for any harm caused due to language barriers, poor internet connections, communication problems and device or technology issues.

Limitation of Liability:

Every single physician and health professional that provides service to patients and users via 121clinicians website and its related platforms holds a current license from the appropriate regulatory authorities in
the jurisdiction that they practice. All Physicians and Health Professionals are independent and are not controlled and governed by 121clincians. The relationship between you as a patient, client or user with physicians and health professionals is a ” Doctor-Patient” or ” Health Professional -Patient” or ” Health Professional-Client” relationship and all of these relationships are regulated by responsible authorities. 121clinicians and its owners and operators are not a party to that relationship. 121clinicians provides the technology required for licensed physicians and health professionals to facilitate their service to patients and clients. No claim of any kind can be brought anywhere and anytime against 121clinicians and its owners and operators for any acts or omissions of physicians and health professionals. Staff at 121clinicians are Non-Medical and are not trained physicians or health professionals no patient or user is supposed to perceive them as physicians and health professionals and in uncommon situations that you may perceive a medical advice has been provided to you or your loved ones you must not follow any advice without first confirming with your licensed physician or health professional.

Your obligation to improve the quality of the service you receive: 

If you create an account and have a patient profile and have booked a consultation with a physician or health professional it is in your best interest to send any relevant existing medical records, investigation
results or medication list related to your health to be uploaded into your medical file. It is your responsibility to bring your existing medical information to the attention of physicians and health professionals. Physicians and health professionals proactively inquire about your past medical history and existing medical problems but physicians and health professionals are not liable for any harm caused due to lack of knowledge about your pre-existing medical information. Also it is a requirement for
users and patients to have a fully functional phone, tablet or computer with a reasonable internet speed to allow appropriate video consultation to occur. Physicians and health professionals are not liable for any harm caused due to poor connection, communication problems, device or technology issues or language barrier problems.

Complaints and Claims against Physicians and health professionals:

Because 121clinician platform is the main means of communication between you and physicians and health professionals we communicate some of their important terms of service to you.

Physicians and Health professionals are willing to receive any feedback, suggestions to improve, or any complaints you may have. Physicians and health professionals are committed to provide you with the care to the best of your satisfaction and they will strive to achieve your full satisfaction. If you are still unsatisfied with the care and the response you received; any complaints against any physician or health professional must be directed to the licensing authority that has issued the license to practice to that physician and health professional.

Governing Law and Exclusive Jurisdiction Agreement for physicians and health professionals:

After your complaints have been fully investigated and finalized by appropriate licensing authorities and you receive your formal response if you still dissatisfied with their decision you will have the right to pursue your complaints or claims to the appropriate decision review authority or court only in the jurisdiction that the physician or health professional resides or holds the current license to practice. 

Governing Law and Exclusive Jurisdiction Agreement for 121clinicians:

Any claims against 121clinicians and its owners and operators must be heard only at Supreme Court of British Columbia, Canada as the exclusive jurisdiction.

Maximum Liability for 121clinicians:

Because of the nature of the service that 121clinicians offers the is a maximum total liability of Five Hundred Canadian dollars for any kind of proven harm or damages caused by 121clinicians platforms.

Maximum Liability for physicians and Health Professionals: 

The maximum liability for physicians and health professionals is tied to where the patient or client and the physician or health professional resides. If physician and health professional and the patient both reside in the same province and country the maximum liabilities are defined by Government Authorities or Court systems in that jurisdiction. 

If the patient or client resides in a different country than the physician or health professional ,patients and clients must be aware that the physicians and health professionals are licensed to practice in the jurisdictions that they hold license to practice and their prescriptions, investigation requests or referrals generally are only accepted in that jurisdiction, therefore you must strive to book your appointments with the physicians and health professionals that hold license in the jurisdiction that you reside. Despite this if you proceed and choose to have an appointment with a licensed physician that holds license from a jurisdiction different form the jurisdiction that you reside you are deemed to agree that those visits are only for informational service. In this circumstance you must always have a responsible treating physician in the jurisdiction that you currently reside. The details of your responsible treating physician in your place of residence must be provided to the physicians and health professionals at 121clinicians. There is a maximum total liability of Five Thousands US dollars for any harm caused if you chose to have consultation with a physician or health professional who resides or holds license in a different jurisdiction than your place of residence. 

Cancelation and refund policy:

We ask understand that people’s circumstances change and they may have to change or cancel appointments we appreciate if you could please let us know to change or cancel your appointment at your earliest opportunity.

Insured patients and insured services we apply a two times waiver policy which means if you cancel your appointment there will be no charge to you. After the second time if cancelation is less than 48 hours
before the appointment time you will be charged a $35 Canadian. If cancellation is more than 48 hours in advance of your scheduled appointment there will be no charge.

Private pay consultations: For cancellation of private pay consultations if cancellation is less than 24 hours to the appointment time there will be no refund for the cancelled consultation appointment. If cancellation is more than 24 hours before the appointment there will be a $35 Canadian dollars charge for each session of bookings and you will be refunded the remainder amount.

Good Character Requirements:

The main goal of 121clinicians is to improve the health and well-being and quality of life of people around the globe by providing easy and convenient access to qualified physicians and health professionals. You must, under no circumstances, whether direct or indirectly involve in any act or activity that has the potential to adversely affect providing our services to our patients, clients and physicians and health professionals. Some examples would be trying to tamper with our website and integrated platforms, copying our contents without permission, creating forged or inaccurate accounts, spam messages and phone calls and any action in general that could potentially harm or impair our functions.  

In addition, physicians and health professionals and staff are all professionals of good character and will treat you respectfully at all times and they expect the same from you.

Breach of our terms and conditions:

We may suspend or cancel accounts if we reasonably believe that you are in breach of any provisions of our terms and conditions and depending to the nature of the breach and circumstances we may take legal
action against you to recover damages.

Your other obligations:

We have tried to make our website easy to follow and easy to understand and you must read the information on our website specially physician and health professional profiles and questions and answers and familiarize yourself with our services and service providers before using our service. If you have any questions or concerns or suggestions for improvements please do not hesitate to contact us.

The right to change our terms and conditions of use:

We have the right to add, amend, omit and edit our terms and conditions of use from time to time without your prior knowledge, permission or notification to you but it will always be available in our website.
